As a user/subscriber, you are obligated to other Subscribers/ Employers/ Recruiters as well as JobsDialog (TMI e2E Academy Private Limited).   2. Provide accurate information to us and update it as necessary
  3. Review and comply with our Privacy Policy on a time to time basis
  4. Review and comply with notices sent by JobsDialog concerning the services in a timely manner
  5. Use the services in a professional manner.
  6. Use your real name on your profile as per your educational records.
  7. Abide by the terms and conditions of the current Privacy Policy, Unacceptable Actions Policy , Terms of Use, and other policies of JobsDialog. This includes respecting all intellectual property rights that may belong to third parties, such as trademarks or copyrights
  8. Keep your username and password secure and confidential and not share it with others.

You further declare that in case you violate any provisions of the Information Technology Act, 2000 and/or rules, regulations, guidelines, byelaws and notifications made thereunder, you shall alone be responsible and liable for civil and criminal liability there under or under any other law for the time being in force.

Eligibility

To be eligible to use the service, you must meet the following criteria and represent and warrant that you are not currently restricted from the services, are not a competitor of JobsDialog or are not using the services for reasons that you are in competition with JobsDialog (TMI e2E Academy Private Limited.

You must be 18 years of age or older to visit or use jobsdialog.com in any manner. You will only maintain only one JobsDialog account at any given time. You have full power and authority to enter into this agreement and doing so will not violate any other agreement to which you are a party.

You will not violate any rights of JobsDialog or third party, including intellectual property rights such as copyright or trademark rights.

You agree to provide at your cost all equipment, software, mobile access, and internet access necessary to use the services. By visiting jobsdialog.com or accepting these Terms of Use, you represent and warrant to the Company that You are 18 years of age or older, and that you have the right, authority and capacity to use the Website and agree to and abide by these Terms of Use.

JobsDialog does not share personally identifiable data of any individual with other companies/ employers/recruiters without obtaining permission from the candidate. We reach out to you to seek permission or ask your acceptance through a job notification sent to your registered email ID with us or specifically call you out to seek your permission to apply to a job posting on your behalf. Our service to organisations/employers/recruiters allows them to export/ download your information to effectively manage their recruitment process. You may limit or prevent organisations/employers/ recruiters from exporting your profile information by configuring or changing you email/ SMS/call related notification settings.

You undertake to use jobsdialog.com solely for the purpose of job search. The features of JobsDialog may be used only by individuals seeking employment and/or career information and by employers seeking employees. In the case of any conflict between these Terms of Use and any contract you have with JobsDialog, the terms of your contract will prevail. The term “post” as used herein shall mean information that you submit, publish or display on a JobsDialog site.

You undertake that you will not use any content from jobsdialog.com for other works, apart from the works agreed to in this Terms of Use, with a commercial motive without prior written consent from TMI e2E Academy Private Limited. You shall not utilise the services offered by JobsDialog in any manner so as to impair the interests and functioning of JobsDialog.

You acknowledge, agree and give your consent that when submitting your resume for storage in our resume database, JobsDialog (TMI e2E Academy Private Limited) is not responsible for the use made of resumes by organisation/employers/recruiters who ordered them through JobsDialog’s recruitment services.

JobsDialog, through its contact centres also reaches out to you and you can have your personal and identifiable information updated through this service, by using assistance of the contact centre agent or authorised representative.

You acknowledge, consent and agree that JobsDialog (TMI e2E Academy Private Limited) can disclose your resume and contact details ("Personal Information") to prospective employers/ companies/recruiters who have purchased JobsDialog’s recruitment services in order to seek recruit or shortlist qualified candidates.

You agree that JobsDialog may use your personal information to contact you and deliver information relating to the job search agent's search results to you, or provide administrative notices or communications applicable to your use of the Website.

The JobsDialog website acts as a ‘connect’ between companies/employers and recruiters who are registered with us and who post job opportunities on our website and candidates who post their resumes on JobsDialog. JobsDialog is not a recruiter. JobsDialog (TMI e2E Academy Private Limited) is not to be considered as an employer with respect to your use of the Website but only a facilitator to the transaction of recruitment. It is not involved in the actual transaction between employers and the jobseeker/candidate. JobsDialog shall not be responsible for any employment decisions, for whatever reason made by any entity posting jobs on the Website

JobsDialog (TMI e2E Academy Private Limited) cannot guarantee and does not have control over the quality, accuracy, safety or legality of the jobs posted and does not guarantee the ability of employers to offer job opportunities. JobsDialog assumes no liability for the authenticity, quality and accuracy of information from any third parties such as companies/individuals/employers/ recruiters, which is displayed on JobsDialog (TMI e2E Academy Private Limited) website. JobsDialog cannot guarantee or monitor the organisation/employers/recruiters, who register on the JobsDialog website or domains owned and operated by TMI e2E Academy Private Limited. It shall be your responsibility to conduct your own due diligence of the organisation before attending interviews or joining the organisation/individual.

You acknowledge that there are risks, of dealing with people/companies/employers/recruiters who are acting under false identities. JobsDialog (TMI e2E Academy Private Limited) cannot and does not confirm that each user is who they claim to be. In the event that you have a dispute with one or more users, you shall release JobsDialog (TMI e2E Academy Private Limited) its group companies and their respective officers, directors, employees and authorised representatives, from claims, demands, damages or any other form of liability (actual and consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

JobsDialog prohibits you from insertion of any URL, weblink or website while posting your resume on jobsdialog.com.

The JobsDialog website contains links to third party websites. JobsDialog does not take responsibility for the content of the third-party websites and URLs, and does not make any representations regarding the content or accuracy of materials on such third party websites. If you decide to access these third-party websites, you do so at your own risk.

JobsDialog reserves all of its intellectual property rights in the service. JobsDialog and TMI e2E Academy Private Limited logos and other JobsDialog trademarks, service marks, word marks, graphics, and logos used in connection with JobsDialog are trademarks or registered trademarks of JobsDialog. Any literature/data created and published by JobsDialog on its website are exclusively copyrighted by JobsDialog. Other trademarks and logos used in connection with JobsDialog may be the trademarks of their respective owners. This agreement does not grant you any right or license with respect to any such trademarks and logos.

User Registration, Login and Password

You are solely responsible for maintaining the confidentiality of your JobsDialog account, user ID, access information and passwords. You are not authorised to share your password or other account access information with any other party, temporarily or permanently, and any breach of this obligation may tantamount to disabling of your JobsDialog account and JobsDialog services.

You agree to immediately notify the Company of any unauthorised use of your account, and passwords. jobsdialog.com (TMI e2E Academy Private Limited) assumes no responsibility or liability for their improper use of your user ID, password or any information relating to your account access online/off-line.

You understand and acknowledge that if you close your account or your account is terminated, all your account information from JobsDialog, will be marked as deleted and may be deleted from JobsDialog's databases. Information may continue to be available for some period of time because of delays in propagating such deletion across JobsDialog’s web servers. JobsDialog further reserves the right to delete your account and all of your Information after a significant duration of inactivity and reserves the right to reject and delete any resume/insertion or information/data fed in by you without assigning any reason.

You understand and acknowledge that you are prohibited from introducing/posting or transmitting information or software, which contains a computer virus, or a contaminant, worm or other harmful components on the internet or on JobsDialog (TMI e2E Academy Private Limited) site or sub- domains or on any affiliate sites or any other network system. You undertake that the services offered by jobsdialog.com shall not be utilised to upload, post, transmit, publish, or distribute any material or information that is unlawful, or which may potentially be perceived as being harmful, threatening, abusive, harassing, defamatory, libelous, vulgar, obscene, or racially, ethnically, or otherwise objectionable. Any conduct of the user in violation of this clause shall entitle JobsDialog (TMI e2E Academy Private Limited) to forthwith terminate all your services without any notice and further initiate appropriate legal proceedings against you.

You expressly state that the resume/insertion or information/data/images being fed into the network of JobsDialog by you is correct and complete in all respects and does not contain any false, distorted, manipulated, fraudulent or misleading facts or averments. You undertake not to publish inaccurate information or add to a content field, content that is not intended for such field in the designated fields on the profile form (e.g., do not include a link, an email address or phone number in the name field). You acknowledge and agree that you are solely responsible for the content and the accuracy of any resume or material contained therein placed by you or placed by our contact centre agent or authorised representative on your behalf on the JobsDialog website. JobsDialog has the right to make all such modifications/editing of resume in order to fit resume in its database. JobsDialog (TMI e2E Academy Private Limited) expressly disclaims any liability arising out of the said resume insertion/information/data fed into the network of JobsDialog by the user.

You further agree to indemnify JobsDialog against all losses incurred by JobsDialog (TMI e2E Academy Private Limited) due to any false, distorted, manipulated, defamatory, libelous, vulgar, obscene, fraudulent or misleading facts or otherwise objectionable averments made by the user on the network of JobsDialog.

JobsDialog reserves the right to offer third party services and products to you based on the preferences that you identify in your registration and at any time thereafter or you have agreed to receive; such offers may be made by JobsDialog or by third parties.

You are solely responsible for obtaining, at your own cost, all licenses, permits, consents, approvals and intellectual property or other rights as may be required by you for using the JobsDialog Service. JobsDialog offers neither any guarantee nor warranties or any specific results that there would be any response at all once the resume is prepared by the contact centre /authorised representatives or by the subscriber himself by insertion of information/data on the website, jobsdialog.com. The assistance provided by the contact centre /authorised representative is purely meant to assist you in completing/ updating the necessary information and fields of information as requested on the JobsDialog website. This is provided in a best effort basis to help you in completing primary information required by companies/employers/recruiters. No advice or information, whether oral or written, obtained by you from JobsDialog (TMI e2E Academy Private Limited) or from the Website shall create any warranty not expressly stated herein.

JobsDialog (TMI e2E Academy Private Limited) will make best efforts but does not warrant that any of the web sites or any affiliate site(s) or network system linked to it is free of any operational errors nor does it warrant that it will be free of any virus, computer contaminant, worm, or other harmful components. In case while using the world wide web/internet you receive a spam or virus which includes a link to jobsdialog.com or to any other site maintained, operated or owned by TMI e2E Academy Private Limited, JobsDialog ( TMI e2E Academy Private Limited) cannot be held responsible for the same. TMI e2E Academy Private Limited assumes no responsibility for such mails.

You acknowledge and undertake to respond to e-mail/SMS notifications and phone calls, promptly. Repeatedly avoiding calls from our authorised representatives informing you about job opportunities where your profile is short listed, will be considered as your lack of interest or waiver towards job opportunities and as a result of which, you may be blacklisted from our service. In case you agree to attend interviews, which you have confirmed via email or on call with our authorised representative, you will honour your commitment by attending the interview without fail.

If JobsDialog (TMI e2E Academy Private Limited) is able to obtain a job offer to your satisfaction, then you will accept or reject the offer within 7 days of receipt of the offer.

In case you accept the above offer, then you will inform JobsDialog of your resignation date and last working date at your current employer via email to JobsDialog (TMI e2E Academy Private Limited) in 7 days of acceptance of offer.

After you accept the offer, you authorise JobsDialog (TMI e2E Academy Private Limited) to let go of the “backup” candidates that have been shortlisted for the position by the employer and that you confirm that you will join on or before the due date agreed with JobsDialog (TMI e2E Academy Private Limited) on behalf of the employer.

You undertake that you will not engage in any action that directly or indirectly interferes with the proper working of our website or places an unreasonable load on JobsDialog’s infrastructure. You also undertake that you will not use manual or automated software, devices, scripts robots, other means or processes to access, “scrape,” “crawl” or “spider” any web pages or other services contained in the site or use bots or other automated methods to access or create accounts on JobsDialog,

You undertake that you will not access, via automated or manual means or processes, JobsDialog for purposes of monitoring JobsDialog’s (TMI e2E Academy Private Limited) availability, performance or functionality for any competitive purpose.

You undertake that you shall not lease, rent, sell/re-sell, trade access to JobsDialog or any information therein, or the equivalent, in whole or part. JobsDialog would not be held liable for loss of any data technical or otherwise, or of the resume/ insertion or information/data or particulars supplied by you due to acts of god or reasons beyond its control like corruption of data or delay or conditions that are beyond JobsDialog's reasonable control including but not limited to strikes, riots, civil unrest, government policies, tampering of data by unauthorised persons like hackers, distributed denial of service attacks, virus attacks, war and natural calamities.

Any agreement for a subscription/usage entered into by you with JobsDialog (TMI e2E Academy Private Limited) does not confer exclusivity of service on you.

JobsDialog Service

JobsDialog’s service allows only registered users, who have a valid login ID at JobsDialog website to upload their resumes, profile and photograph. These uploaded resume’s and photographs hosted on JobsDialog (TMI e2E Academy Private Limited) website for display, are used by companies/ employers/ recruiters on JobsDialog website, JobsDialog's affiliates websites and on JobsDialog affiliates and syndicated third party sites, and for the public posting, viewing. JobsDialog does not share personally identifiable data of any individual with other companies/entities without obtaining permission from the subscriber/user. The interest of the subscriber for a specific job posting will be ascertained before we send out your resume to the employers/companies/recruiters registered with us who use our recruitment services.

How we communicate with you

We communicate with you using JobsDialog notifications, email, SMS/mobile text messaging and call you on the registered mobile number available to us. by agreeing to this Terms of Use, you consent to the use your personal data in the form of e-mail/mobile/landline phone number(s) being used by JobsDialog to forward relevant job alerts and other information as and when they become available. We may send you email, SMS/mobile text messages or call you relating to the accessibility which relates to your registration - user ID and passwords, account and engagement related information, usability of service and its features, availability of the services or other service-related issues. We also send messages to your email and registered mobile number directly or on behalf of employers registered with us and our partners, these including details of job opportunities and information on employers/companies/recruiters that are hiring. JobsDialog tracks the open rate of your emails. These messages will be sent to you based on your profile information and messaging preferences. You may change your email and contact preferences at any time by signing into your account to opt out from receiving notifications. If you opt out, you will continue receiving service messages from JobsDialog. We will however stop all job related notifications to you; we will also keep your profile on hold and not shortlist you for any job posting during this period. You may change your e-mail/ SMS related notification settings by logging into your account.

Your Rights to Access, Correct, or Delete Your Information, and Closing Your Account

You have a right to access, modify, correct, change or delete your personal information on your JobsDialog account at any time by editing your profile, deleting content that you have posted, or by closing your account. If you close your account, your account will be deactivated from the Service within 7 working days; you may not be able to access, correct, or delete any information about you that other organisation/employers/recruiters copied or exported out of JobsDialog, because this information may not be in our control. We retain the personal information you provide while your account is in existence. JobsDialog (TMI e2E Academy Private Limited) may retain your personal information even after you have closed your account or may retain information for as long as is necessary to provide support-related reporting, analysis or to comply with any regulatory, legal obligations, resolve disputes between members, prevent fraud and abuse, or enforce this Terms of Use, Privacy Policy and Unacceptable Actions Policy.

Notifications and Service Messages

By agreeing to the Terms of Use, you explicitly agree and are okay with us providing you with important notices and contacting you on the website (your account on JobsDialog), through SMS , Call on your registered mobile number with us and notify you on your registered email ID with us. We may also contact you on any other alternate number provided by you to us. We would also use delivery services including the postal / Courier service to connect with you about your JobsDialog account or services associated with JobsDialog.

The contact information you provide must be accurate or you may not receive important notices.

User Surveys and Testimonials

We conduct our own surveys and polls and also help third parties do this type of research. Your participation in surveys or polls is solely at your discretion. If you provide any testimonials about our services, we may post those testimonials on our website or to third parties. Copyright Infringement or Other Intellectual Property Rights of Third parties.

Jobsdialog.com (TMI e2E Academy Private Limited) and all of our affiliated companies of TMI group respect the intellectual property ofThird parties ,the subscriber shall not infringe on any intellectual property rights of any person / entity or retain information / download any information from any computer system or otherwise with an intention to do so.

Any unauthorized copying, reproduction,modification, distribution,public performance or public display of copyrighted works constitutes infringement of copyrightofthe owners’ rights. As a condition to your use of jobsdialog.com, You agree not to use jobsdialog.com or any other JobsDialog Site to infringe the intellectual property rights of others in any way. Any infringement will lead to termination of your account/ accounts with JobsDialog.

Notwithstanding the foregoing.

On non-conformance by users of any of the aforesaid terms, JobsDialog may in its sole discretion, restrict or terminate the offending User's ability to access the JobsDialog Site(s) and determine whether to take any other actions or to remove or request the removal of the User Content. JobsDialog has no liability or responsibility to Users for performance or non-performance of such activities. Additionally, JobsDialog has the right to initiate appropriate proceedings against the offending user as per law.

Indemnification and Waiver of Claims

You hereby waive all claims and agree to defend , indemnify and hold harmless JobsDialog( TMI e2E Academy Private Limited) its affiliates, their authorised representatives, their officers, directors, employees and agents, partners from and against any or all liability of claims, damages, losses actions or demands, including without limitation reasonable legal charges, and investigations accounting fees, alleging or caused by

JobsDialog shall provide notice to You promptly of any such claim, suit, or proceeding.

Disclaimer of Consequential Damages

In no event shall JobsDialog, its suppliers, or any third parties mentioned on the web site be liable for any damages whatsoever (including, without limitation, incidental and consequential damages, lost profits, or damages resulting from lost data or business interruption) resulting from the use or inability to use the web site and the material, whether based on warranty, contract, tort, or any other legal theory, and whether or not the company is advised of the possibility of such damages.

JobsDialog will not be party to any legal proceedings between you and any party contracted through the site including Employers/ Companies/ Recruiters. In case JobsDialogis implicated in any legal proceedings, costs will be recovered from the party that names JobsDialog. JobsDialog however will abide with any court order served on it through due process.

Jurisdiction for any disputes arising from and related to this contest shall be Hyderabad, India to the exclusion of all other courts.All/ Any disputes arising out of the transactions between subscriber and JobsDialog shall be resolved in accordance with the laws of India as applicable.

Amendments In Terms of Use

JobsDialog shall have the right to amend, vary or modify the Terms of Use, Privacy Policy of JobsDialog Website at any time, without giving any prior notice to You and such amendment shall be effective immediately upon inclusion / posting of such amendment on JobsDialog Website.

These "Terms of Use" and "Privacy Policy" of JobsDialog site constitute a binding agreement between You and JobsDialog, and is accepted by You upon your use of the JobsDialog Site.
